Nursing Home Sued for Sexual Assault on Resident

The Jones Law group, LLC has filed a lawsuit in Franklin County Court of Common Pleas against a Westerville nursing home and others for alleged shocking sexual acts or sexual assault performed on a resident. Our client, who sadly suffers from a host of psychiatric disorders including schizoaffective disorder, bipolar disorder and personality disorder, was a resident of the nursing home in the winter and spring of 2013 for long-term residential, medical and psychological care and treatment for our client. Part of that care and treatment included our client receiving regular blood and lab work. Last May, a phlebotomist came into a resident’s room in order to take blood samples from her. In the course of performing these services, the phlebotomist engaged in gross acts of sexual assault that have severely injured our client. We have filed a lawsuit against the phlebotomist, the lab company he worked for and the long term care facility.

We believe that residents at nursing homes and long term care facilities are entitled to receive quality care and treatment and not be subjected to nursing home abuse or neglect from the staff and from any outside vendors with whom the facility contracts to perform services. The staff at these facilities is required to conduct themselves with the utmost care in their dealings with the residents, and to provide a safe living environment for the residents.
